This agreement is between the ‘Client’, whose name and address is listed below, and Melissa Behr-Maahs, the ‘Photographer’ of Melissa Maahs Photography, 310 Sandringham Drive, Courtice, ON L1E 3A7. Phone: (905) 442-1657
The following outlines the agreement between you and Melissa Maahs Photography (MMP). By signing, you agree to the following terms and conditions:
- 20 minutes is allotted for the micro session, so it’s important that you show up on-time, or even a few minutes early so your pet has time to unwind and adjust to being at a new location.
- Only the pet who won the micro session will be photographed. No other pets or people are included in the photo session. If you would like to include other pets or family members, you must upgrade to a custom photo session and pay the fee ahead of time.
- You must be available to travel to the outdoor location chosen by Melissa, in Durham Region, during the golden hour (this changes depending on the time of year, generally it’s about 1 to 1.5 hours before sunset).
- Your pet does not have to be off leash to be photographed, but should you decide to unleash your pet, you take full responsibility for your pet while on or off leash.
- Be sure to bring a collar. If your pet wears a body harness while outdoors, that will be required to be taken off during the photoshoot as they are not an ideal look for a pet portrait.
- Melissa will photograph a variety of photos during the 20 minute micro photoshoot, but the final image to appear in the calendar will be chosen by Melissa. A digital version and a 5×7 print version of the final chosen photo will be sent to you. The final photo will not be revealed or sent to you until the calendar is published later this fall.
- LATE ARRIVAL POLICY: If you arrive late to your session, this will affect your scheduled time and your session will still only run to the scheduled end time.
- NO-SHOW POLICY: if you fail to show up for your scheduled session without at least 24 hours notice, you forfeit your complimentary micro session and your spot in the calendar.
- CANCELLATION/RESCHEDULE POLICY: 24 hours notice is required if a cancellation and reschedule is needed. If you cannot reschedule to one of the available dates offered, you forfeit your complimentary micro session and your spot in the calendar.
- LIMIT OF LIABILITY: MELISSA MAAHS PHOTOGRAPHY, ITS WORKERS, AND ALL REPRESENTATIVES ARE NOT RESPONSIBLE FOR ANY INJURIES TO ANY PARTIES, including pets, before, during, or after a session. MELISSA MAAHS PHOTOGRAPHY, ITS WORKERS, AND ALL REPRESENTATIVES ARE NOT RESPONSIBLE FOR ANY MEDICAL BILLS, PERSONAL TREATMENT OR DOCTORS/VET VISITS if an injury happens during a session. MELISSA MAAHS PHOTOGRAPHY, ITS WORKERS, AND ALL REPRESENTATIVES ARE NOT RESPONSIBLE for any damaged property during a session and the client agrees to pay any damages if caused by clients during a session.
- DIGITAL AND PRINTS COPYRIGHT: All images and copyrights are the property of Melissa Maahs Photography. In exchange for services provided, Melissa Maahs Photography retains the exclusive right to copy, edit and distribute any/all images created under this agreement to the general public, for any reason, including but not limited to: advertising, marketing, sales, print competitions, educational seminars, and monetary gain. The mediums for display could include newspapers, magazines, books, television, and the internet, but are not limited to only those mediums. Melissa Maahs Photography retains these rights even if image files are turned over to the Client.
- Once you receive the digital version of the final photos, you are welcome to share and print as many copies as you desire. Please note that all digital versions of Melissa’s work are custom calibrated to our professional printing lab. Prints and many other photographic products are available for purchase. Melissa Maahs Photography cannot be held responsible for print quality issues, including colour variations if the client chooses to print photos at any other photo printing services outside of the printing service MMP offers.
- The digital version of complimentary photo included with the micro session will be provided to you via online digital download, which will remain active for 30 days. It is your responsibility to ensure that you download your photo during this time. Once your gallery expires, images go into archives and if you need another online gallery from which to download, there is a $50 retrieval fee. While Melissa Maahs Photography makes every effort to keep your digital photos on record for 90 days, we cannot be held accountable for system failure, human error, or any other reason for lost digital photos once your files are delivered.
- CLIENT’S USAGE: The client is obtaining digital files for personal use only, and shall not sell said digital files or authorize any reproductions by parties other than Melissa Maahs Photography. The client may print, display, electronically transfer, and publish on personal websites and social media platforms. Prints for publication (such as editorial, public relations or advertising use) require prior written consent from Melissa Maahs Photography. The client is prohibited from applying for copyright registration or selling of any digital or print version of any photos provided by Melissa Maahs Photography, making ‘derivative works’ or otherwise modifying, including editing and/or manipulating electronic files; this includes applying social media filters.
